Any breach of the Capricorne fidelity program General Conditions by the Member is likely to lead to his/her exclusion without notice, the later involving the loss of all his/her points with no indemnity being thus paid.
In any case, the Member remains the sole responsible of the use of vouchers issued upon his/her request, for personal or third party use.
The Member also remains responsible for any claim or third party possible claim because of his/her participation to the fidelity program or use of the vouchers he/she would be entitled to, including with tax or government administrations, for any duty, right or tax owed.
Any Member will be responsible for informing all pertaining third party or legal entity paying the airplane tickets or accredited services, on the points and advantages obtained through Capricorne fidelity program.
In the event of a voucher being unduly turned down, Air Austral liability will be limited to the value of that voucher. Any compensation will only be made in the form of an equivalent voucher.
Air Austral reserves the right to modify the fidelity program general conditions, in particular the scales and the obtaining conditions of vouchers, cancellation or replacement of Capricorne fidelity program by another program, at any time with a three-month notice.
Any Member noting the loss or theft of his/her Capricorne fidelity card will immediately notify Air Austral in writing. Air Austral declines all responsibility as for the fraudulent use of that card.
Legislations in some countries are likely to impose some restrictions as for the conditions of implementation of and/or participation in Capricorne fidelity program. In order to comply with these legislations, Capricorne and Air Austral will be entitled to immediately implement new legal instructions and to modify its program accordingly, without notice. Air vouchers are submitted to the effective general conditions of transport.
Air Austral declines any responsibility as for the damage occurring during the use of a voucher, with the exception of damage occurred during transport for which the carrier’s responsibility is governed by the Warsaw convention or by French law when it comes to domestic transports.
The Member is entitled to not participate in Capricorne fidelity Program any more. He/she will then have to notify Air Austral in writing and give his/her card back. Accumulated or transferred points will then be lost.
People under 18 (from 2 years of age on) who participate in this fidelity program are subject to the prior signature of their guardian for each transaction related to this fidelity program, in particular for any voucher request.
In accordance with the Law of January 6, 1978, a right of access and of rectification to the information held in the Air Austral Capricorne fidelity program files is provided.
French law alone will be applicable for the execution of the contract and the tribunals of Saint-Denis, Reunion Island will be the only proficient ones in coming to a decision in case of dispute regarding this fidelity program.
